Considering that culture is the product of creative and human processes, it is believed that intellectual property is a legal tool that allows for its protection given that it helps conserve, safeguard and preserve its tangible and/or intangible assets. In the case of digital heritage, which is made up of digital elements that should be preserved due to their cultural value, some challenges have arisen regarding their legal protection. One of these challenges is the lack of clarity about how the (...) elements that comprise it should be protected, giving rise to doubts about how intellectual property should help solve this conflict. This article presents the discussion regarding the protection of digital heritage in Colombia, how copyright is becoming an instrument that contributes to its legal protection, and the challenges to further develop it in the country. Cognitive symptoms after COVID-19 have been increasingly recognized several months after the acute infection and have been designated as “brain fog.” We report a patient with cognitive symptoms that started immediately after COVID-19, in which cerebrospinal fluid biomarkers were highly suggestive of Alzheimer’s disease. Our case highlights the need to examine patients with cognitive symptoms following COVID-19 comprehensively. A detailed assessment combining clinical, cognitive, and biomarker studies may help disentangle the underlying mechanisms associated with cognitive dysfunction in each case. The main interest of this paper is to understand how different theories have influence in the anthropological study of boundaries spaces. First, I will refer to Wolf’s and Barth’s critique against the particularism of the first ethnographies. These first anthropologists maintained an isolated and separated conception of culture and consequently, they were unable to apprehend links between different human groups. In contrast, I will mention new approaches, more sensible to the differential situations in borders and the existence of transnational nets (...) among regions. Lastly, I will allude to the difficulties that three contemporary anthropologists must face, when they link these new approaches with some postmodern concepts and therefore, they cannot apprehend either the complexity of the boundaries. En este artículo se va a tratar de comprender cómo la elección del marco teórico va a tener consecuencias en la realidad estudiada, en el caso concreto de la antropología de los espacios fronterizos. En primer lugar, nos referiremos a las críticas de Wolf y Barth al particularismo característico de las primeras etnografías, dado su concepto aislado y cerrado de cultura, que les impedía reconocer los vínculos y contactos entre distintos grupos humanos. Como contraste a los particularismos, recientemente han aparecido nuevos enfoques teóricos, más atentos a las realidades fronterizas y al establecimiento de redes transnacionales entre distintas regiones; entre ellos, destacaremos las aportaciones de tres antropólogos contemporáneos quienes vinculan los enfoques transnacionales con algunos conceptos propios de la filosofía posmoderna y como consecuencia tienen dificultades aprehender la complejidad de los espacios fronterizos. En este artículo analizo las críticas recientes de Judith Butler al escepticismo cartesiano y al constructivismo posmoderno, para explicar el distanciamiento de Butler respecto de posturas constructivistas y, al mismo tiempo, como un argumento para afirmar la dimensión ética y con pretensión de universalidad de su defensa de las vidas precarias.

En este artículo quisiera aludir a las tesis de Bourdieu sobre la dominación simbólica, incidiendo en su faceta androcéntrica; para, a continuación contemplar cómo, debido al carácter incorporado de dicha estructura (esto es, a que su eficacia radica en que el dominado contribuye a su propia dominación), algunas teorías y prácticas feministas, como el feminismo de la diferencia de Luce Irigaray, los planteamientos éticos y políticos de Benhabib y la subversión de la identidad que promueve Butler, pueden llegar a reproducir (...) las diferencias que pretendían combatir. Finalmente, quisiera plantear las opciones que pueden llevar a cabo los distintos feminismos (y otras figuras dominadas) para evitar estos problemas. (shrink)

En este artículo desarrollo una crítica hacia posturas transexcluyentes, que niegan el reconocimiento como mujeres de las mujeres trans, bajo la óptica de la filosofía del lenguaje cotidiano del segundo Wittgenstein. Aunque este autor nunca se posicionó en ese tema, varias de sus intérpretes feministas, como Toril Moi, Cressida Heyes y Hilde Lindemann-Nelson, han elaborado una crítica antiesencialista para evitar el reduccionismo biológico del término «mujer» y ampliar su uso. Siguiendo a estas filósofas, mi tesis es que varios contenidos de (...) la obra tardía de Wittgenstein (uso cotidiano del lenguaje, argumento contra el juego de lenguaje privado, parecidos de familia y conceptos de límites borrosos) pueden contribuir a aclarar ciertos usos del concepto de «mujer» y a criticar los presupuestos esencialistas que subyacen a las propuestas feministas transexcluyentes. En este artículo quisiera contemplar los argumentos de dos autores muy distintos, Seyla Benhabib y Slavoj Žižek, quienes coinciden en señalar que la aportación de Judith Butler a la filosofía política no resulta demasiado convincente por no considerar la tendencia utópica que toda teoría y práctica política debería mantener. Nos aproximaremos en orden cronológico a estas dos críticas, orden que nos va a permitir entender mejor la evolución del pensamiento de Butler.

En este artículo voy a profundizar en una interpretación aplicada de la obra del segundo Wittgenstein, propuesta por José Medina, Miranda Fricker y Peg O’Connor, entre otros. Estos autores equiparan juegos de lenguaje y formas de vida, entienden las reglas de los juegos como normas sociales y trasladan la argumentación del filósofo vienés a un ámbito sociopolítico. Concretamente, José Medina propone un argumento en oposición a los juegos de lenguaje sociales, que es la versión social al argumento de Wittgenstein en (...) oposición a los juegos de lenguaje privados. En segundo lugar, analizaré dos casos: las distintas denominaciones de los indios huicholes y el uso del plural inclusivo por parte de algunos feminismos. Lo más interesante de estos dos casos es que estos grupos proponen significados privados o usos del lenguaje que sólo parecen ser válidos para ellos. Preguntaré si estos usos se pueden entender como juegos de lenguaje sociales y ser criticados desde los argumentos de Medina. Este estudio de casos servirá para evaluar la adecuación, validez y límites de esta interpretación de la obra de Wittgenstein. (shrink)

Neurosurgery for psychiatric disorders, also sometimes referred to as psychosurgery, is rapidly evolving, with new techniques and indications being investigated actively. Many within the field have suggested that some form of guidelines or regulations are needed to help ensure that a promising field develops safely. Multiple countries have enacted specific laws regulating NPD. This article reviews NPD-specific laws drawn from North and South America, Asia and Europe, in order to identify the typical form and contents of these laws and to (...) set the groundwork for the design of an optimal regulation for the field. Key challenges for this design that are revealed by the review are how to define the scope of the law, what types of regulations are required, and how to approach international harmonization given the potential migration of researchers and patients. Parental burnout is a unique and context-specific syndrome resulting from a chronic imbalance of risks over resources in the parenting domain. The current research aims to evaluate the psychometric properties of the Spanish version of the Parental Burnout Assessment across Spanish-speaking countries with two consecutive studies. In Study 1, we analyzed the data through a bifactor model within an Exploratory Structural Equation Modeling on the pooled sample of participants obtaining good fit indices. We then attained measurement invariance across both gender (...) and countries in a set of nested models with gradually increasing parameter constraints. Latent means comparisons across countries showed that among the participants’ countries, Chile had the highest parental burnout score, likewise, comparisons across gender evidenced that mothers displayed higher scores than fathers, as shown in previous studies. Reliability coefficients were high. In Study 2, we tested the relations between parental burnout and three specific consequences, i.e., escape and suicidal ideations, parental neglect, and parental violence toward one’s children. The medium to large associations found provided support for the PBA’s predictive validity. Overall, we concluded that the Spanish version of the PBA has good psychometric properties. The results support its relevance for the assessment of parental burnout among Spanish-speaking parents, offering new opportunities for cross-cultural research in the parenting domain. (shrink)

Introduction As deep brain stimulation (DBS) has shifted to being used earlier during Parkinson’s disease (PD), data is lacking regarding patient specific attitudes, preferences, and factors which may influence the timing of and decision to proceed with DBS in the United States. This study aims to identify and compare attitudes and preferences regarding the earlier use of DBS in Parkinson’s patients who have and have not undergone DBS. Methods We developed an online survey concerning attitudes about DBS and its timing (...) in PD. The survey was distributed nationally in the United States via the Michael J. Fox Foundation Trial Finder, the American Parkinson Disease Association flyers, and as a link on the Parkinson Alliance website. Differences in responses between PD DBS and non-DBS patients were assessed. Results A total of 445 patients with PD met eligibility criteria for the survey of which 160 self-identified as having undergone DBS. Fifty-five percent (n = 124) of non-DBS patients believed that DBS for PD should only be considered after all medication options have been tried. Patients favoring early DBS had fewer concerns regarding the surgery than those favoring later DBS. Conclusion Our findings highlight a variety of important considerations and concerns patients have regarding DBS and its timing. These viewpoints are important aspects of shared decision-making, as they help to identify patients’ preferences, values, and goals, which should enable providers to better navigate, with their patients, the decision path for therapeutic options to consider. Adolescence is the period of growth between childhood and adulthood. This period of development, which goes from 13 to 18 years, is usually presented as critical, due to the profound modifications of physiological and psychological order in this research we worked with a sample of 60 students, from Secondary School No. 8, morning and evening shift. An instrument was made with 45 variables, 5 of them signalytic: age, gender, an average of the previous cycle, performing some extracurricular activity, and shift. (...) The information was processed in the SPSS and STATISTIC programs. The conclusions showed that the student, by showing a need to learn, is able to develop different academic skills through different factors, such as motivation, thus improving their school performance. Thus proposes the development of an intervention model, for training teachers, on motivation methods in the classroom; As well as conferences on the importance of the topic of adolescent motivation and the factors involved in improving academic performance, teachers and parents will be taught and publicity will be developed on the importance of school motivation in adolescents and how it intervenes from home, at school and how this influences academic results. The laudatory assessment of Kant as a philosophical innovator promoted by Germaine de Staël is questioned and his moral epistemology examined in relation to that of Elise Reimarus, Catharine Cockburn, Catharine Macaulay, and Isabelle de Charrière. The moral and political philosophies of the first three, grounded in natural law, are used to undermine Staël's claim that Kant's moral philosophy offers a (...) significant advance over Locke's, a conclusion reinforced through a reading Charrière's critique of Kant. This Article explores the relationship between the legitimacy of international courts and expansive judicial lawmaking. We compare lawmaking by three regional integration courts - the Court of Justice of the European Union, the Andean Tribunal of Justice, and the ECOWAS Community Court of Justice. These courts have similar jurisdictional grants and access rules, yet each has behaved in a strikingly different way when faced with opportunities to engage in expansive judicial lawmaking. The CJEU is the most activist, but its audacious (...) legal doctrines have been assimilated as part of the court’s legitimate authority. The ATJ and ECOWAS have been more cautious, but there is little to suggest that this caution has enhanced the legitimacy of either court. The ATJ has avoided serious challenges from governments, but its rulings have had little political impact. Conversely, the ECCJ’s circumspection has not shielded it from political opposition to its adjudication of clearly-established human rights. This pattern is at odds with the oft-voiced conventional wisdom that expansive judicial lawmaking undermines judicial legitimacy. Our modest goal in this Article is to problematize that claim and to posit an alternative hypothesis - that ICs spark legitimacy challenges due to the domestic political effects of their decisions, regardless of whether those decisions are expansionist. The debate over the propriety of cognitive enhancement evokes both enthusiasm and worry. To gain further insight into the reasons that people may have for endorsing or eschewing pharmacological enhancement, we used empirical tools to explore public attitudes towards PE of twelve cognitive, affective, and social domains. Participants from Canada and the United States were recruited using Mechanical Turk and were randomly assigned to read one vignette that described an individual who uses a pill to enhance a single domain. After (...) reading the vignette, participants were asked how comfortable they were with the individual using the enhancement. People were significantly more comfortable when they read about enhancement of certain CAS domains than others. We found a modest negative correlation between comfort level and the degree to which the PE was perceived as changing core features of the person. We also found a modest correlation between comfort level and the degree to which the PE was perceived as improving success in life. Finally, using a sequential mixed method technique, we found that participants who felt uncomfortable about PE use overwhelmingly focused on a lack of need and, to a lesser degree, expressed concerns about safety; those who felt comfortable about PE use most frequently mentioned the safety of the pill and its ability to provide a positive outcome. The data provide novel insights into public enthusiasms and concerns over the use of PE. (shrink)

David Lewis famously takes mereology ‘to be perfectly understood, unproblematic, and certain". In this chapter, the author proceeds by articulating four theses that Lewis holds about composition. Three of them are familiar; Lewis himself explicitly articulates and relies upon them. The fourth remains implicit, but it is nonetheless important. The four theses include: composition is unique (the same things cannot have two different fusions); composition is unrestricted (any two things whatsoever have a fusion); composition is ontologically innocent (composed entities do (...) not "count" beyond their parts); and composition is unmysterious (it is not problematic to treat it as primitive, and can function in demystifying explanations). The author devotes a section to each thesis: explaining what it says, pointing to the texts that illustrate that Lewis believes it, and explaining why Lewis believes it. This paper defends the liberal arts as an effective way to acquire habits of thought (creativity, skepticism), as opposed to skills. The ability to think creatively, historically, and skeptically can only be acquired slowly, socially, and with a diverse population. While this defense of the liberal arts (as opposed to a skills-focused defense) well supports some of the hallmarks of American liberal arts education (in person, bricks and mortar, not accelerated), it also has some critical implications for how the liberal (...) arts are taught. In this article, I consider an important challenge to the popular theory of scientific inference commonly known as ‘inference to the best explanation’, one that has received scant attention.1 1 The problem is that there exists a wide array of rival models of explanation, thus leaving IBE objectionably indeterminate. First, I briefly introduce IBE. Then, I motivate the problem and offer three potential solutions, the most plausible of which is to adopt a kind of pluralism about the rival models of (...) explanation. However, I argue that how ranking explanations on this pluralistic account of IBE remains obscure and pluralism leads to contradictory results. In light of these objections, I attempt to dissolve the problem by showing why IBE does not require a ‘model’ of explanation and by giving an account of what explanation consists in within the context of IBE. This article feeds into the discussion of transitional issues begun in Volume 2 of Arts and Humanities in Higher Education. It draws on research into A-level students' expectations of university English and how these compare to the experiences of first-year students, university lecturers and A-level teachers. The data presented are drawn from innovative focus group sessions which gave pre-higher education and first-year university students a range of exercises to encourage them to focus on their expectations and experiences of studying English. (...) These data were supplemented with teacher and lecturer interviews. The article concentrates on students' expectations of independent study and the experience of reading. The findings show that there is a mismatch between student expectations and the realities of university study. It is hoped that the outcomes of this research will contribute to a more informed transition from school to university by informing students' expectations before they enter university. (shrink)

In recent years, discussion around memory modification interventions has gained attention. However, discussion around the use of memory interventions in the criminal justice system has been mostly absent. In this paper we start by highlighting the importance memory has for human well-being and personal identity, as well as its role within the criminal forensic setting; in particular, for claiming and accepting legal responsibility, for moral learning, and for retribution. We provide examples of memory interventions that are currently available for medical (...) purposes, but that in the future could be used in the forensic setting to modify criminal offenders’ memories. In this section we contrast the cases of dampening and enhancing memories of criminal offenders. We then present from a pragmatic approach some pressing ethical issues associated with these types of memory interventions. The paper ends up highlighting how these pragmatic considerations can help establish ethically justified criteria regarding the possibility of interventions aimed at modifying criminal offenders’ memories. The ambiguity regarding whether a given intervention is perceived as enhancement or as therapy might contribute to the angst that the public expresses with respect to endorsement of enhancement. We set out to develop empirical data that explored this. We used Amazon Mechanical Turk to recruit participants from Canada and the United States. Each individual was randomly assigned to read one vignette describing the use of a pill to enhance one of 12 cognitive, affective or social domains. The vignettes described (...) a situation in which an individual was using a pill to enhance the relevant domain under one of two possible enhancement conditions, one perceived as enhancing above the norm, what most people recognize as a clear case of enhancement, whereas the other perceived as enhancing towards the norm, with the individual using the enhancement having a modest, but subclinical deficit. Participants were asked how comfortable they were with the individual using the enhancement and about the impact the enhancement might have had in the individuals’ success in life. We found that irrespective of the domain to be enhanced, participants felt significantly more comfortable with ETN than with EAN, and they regarded the enhancement intervention as contributing to greater success in life with ETN rather than EAN. These data demonstrate that the therapy enhancement distinction is morally salient to the public, and that this distinction contributes to the angst that people feel when considering the propriety of CAS enhancement. An effective theory in physics is one that is supposed to apply only at a given length scale; the framework of effective field theory describes a ‘tower’ of theories each applying at different length scales, where each ‘level’ up is a shorter-scale theory. Owing to subtlety regarding the use and necessity of EFTs, a conception of emergence defined in terms of reduction is irrelevant. I present a case for decoupling emergence and reduction in the philosophy of physics. This paper develops (...) a positive conception of emergence, based on the novelty and autonomy of the ‘levels’, by considering physical examples, involving critical phenomena, the renormalisation group, and symmetry breaking. This positive conception of emergence is related to underdetermination and universality, but, I argue, is preferable to other accounts of emergence in physics that rely on universality. (shrink)

Programs for the reform of K-12 science teaching today usually insist that science teachers must introduce their students to the nature of science, as well as to scientific content. The academic field of science studies, however, evinces no consensus about what the nature of science really is. This article examines how science educators and educational researchers have drawn on the fragmented teachings of science studies about the nature of science, and how they have used those teachings as a resource in (...) their own projects. It identifies three competing movements for the reform of science teaching that owe a particular debt to science studies: history and philosophy of science, science, technology, and society, and constructivist pedagogy. The article analyzes some of the deep assumptions about the relationships between research science, school science, and children’s learning that pervade the educational literature. (shrink)
